      April 30 Tax Deadline: APIT & Withholding Tax Compliance in Sri Lanka

      As the financial year comes to a close, businesses in Sri Lanka must prepare for a crucial tax deadline—April 30. This marks the final date for employers and withholding agents to submit their annual tax statements for Advance Personal Income Tax (APIT) and Withholding Tax (WHT) for the 2024/2025 financial year. Timely compliance is essential to avoid penalties and ensure smooth business operations.

      Understanding APIT: Employer’s Responsibility

      The Sri Lankan government replaced the previously applied Pay-As-You-Earn (PAYE) tax with a revised tax policy known as Advance Personal Income Tax (APIT), which came into effect from the year of assessment 2020/2021. This system requires employers to deduct income tax at the source from employees’ earnings, ensuring tax liabilities are settled progressively rather than in lump sums at year-end.

      Who is Subject to APIT?

      • Employees earning above the tax-free threshold specified by the IRD.
      • Company directors receiving remuneration from the company are also subject to APIT.
      • Any other individual earning taxable employment income. Employer’s Responsibilities
      • Deduct APIT tax based on IRD tax tables.
      • Remit the deducted amount to the Inland Revenue Department (IRD) by the 15th of the following month.
      • Submit the Annual Statement of APIT for the previous financial year by April 30, 2025.

      Payments Liable to APIT APIT is applicable to various forms of compensation, including:

      • Salaries, wages, leave pay, overtime, bonuses, pensions, and gratuities.
      • Allowances such as cost of living, rent, travel, and entertainment.
      • Payments reimbursing employee expenses.
      • Payments for redundancy, termination, or loss of employment.
      • Employer contributions to retirement funds and retirement payments.
      • Benefits received as part of employment, including employee share schemes.

      What is Withholding Tax (WHT)?

      Withholding Tax (WHT) is an income tax deducted at the source on specific payments made to individuals and entities. The payer of these amounts is termed the withholding agent. Payments Subject to WHT Withholding Tax applies to:

      • Interest income from bank deposits and financial instruments.
      • Dividends from shares and investments.
      • Professional fees paid to consultants, lawyers, accountants, and freelancers.
      • Rent payments exceeding the taxable threshold.
      • Other payments as per IRD regulations.

      Withholding Agent’s Responsibilities

      • Deduct the appropriate WHT percentage as prescribed by the IRD.
      • Maintain records of deducted payments.
      • Remit the collected amount to the IRD within the required timeframe.
      • Submit the Annual Statement of Withholding Tax by April 30, 2025. Failure to comply with WHT requirements may result in fines and other legal consequences.
